USER AGREEMENT

This User Agreement (hereinafter referred to as the “Agreement”) is a public offer agreement in accordance with Articles 633, 641 of the Civil Code of Ukraine and regulates the terms of use of the website https://kymo.klymazone.com/ (hereinafter referred to as the “Site”), owned and administered by [full legal name and UDRPO] (hereinafter referred to as the “Seller”), which is the copyright holder of the KYMO trademark.
Please carefully read the provisions of this Agreement before using the Site. By visiting the Site, placing an order or registering, you unconditionally agree to the terms of this Agreement.

1. General Provisions
1.1. The Seller carries out online retail trade in cosmetics and care products under the KYMO trademark.
1.2. This Agreement is a public offer, which is considered accepted by the User from the moment of using the Site or placing an order.
1.3. The Agreement applies to orders placed in Ukraine, Poland, as well as other countries where delivery is possible according to the information on the Site.
1.4. The Site operates in accordance with the legislation of Ukraine, in particular:
- The Law of Ukraine "On Protection of Consumer Rights";
- The Law of Ukraine "On Electronic Commerce";
- The Law of Ukraine "On Protection of Personal Data";
- The Civil and Commercial Codes of Ukraine.

2. Registration and processing of personal data
2.1. To place an order, the User can register a personal account or use the purchase without registration.
2.2. The User undertakes to provide true, accurate and up-to-date information. In case of changes in data, the User must update them in his/her profile.
2.3. By providing personal data, the User consents to their processing in accordance with the Law of Ukraine "On Personal Data Protection" and the Privacy Policy.
2.4. The Seller uses personal data for the purpose of:
- fulfilling the order;
- communication with the User;
- informing (including advertising, with the consent of the User);
- fulfilling legal obligations.

3. Placing an order
3.1. The User independently selects the goods on the Site, adds them to the cart and places the order through the appropriate form.
3.2. The prices of the goods are indicated in hryvnias (UAH), zlotys (PLN) or euros (EUR), depending on the selected region. The cost may change due to exchange rate fluctuations or other market factors.
3.3. The final cost of the order, including the cost of delivery, taxes, commissions or possible customs duties, is indicated before confirming the order.
3.4. The Seller has the right to cancel the order in cases of:
- absence of goods;
- technical error on the Site;
- failure to provide or provision of inaccurate information by the User.
3.5. In case of cancellation of a paid order, the Seller shall refund the funds within 7 (seven) banking days from the moment of notifying the User or by negotiation and agreement on the date of possible delivery of the goods.

4. Payment and delivery
4.1. Delivery of goods is carried out:
- in Ukraine - through national delivery services (Nova Poshta)
- in Poland - through national delivery services (Nova Poshta International);
- to other countries - in accordance with the terms specified on the Site (Nova Poshta International)
4.2. Payment methods:
- online payment (bank cards, payment systems);
- other methods specified on the Site.
4.3. In the case of international delivery, the User is solely responsible for paying customs duties, taxes or other mandatory payments in the country of receipt.
4.4. The currency of debiting funds depends on the selected country of delivery and payment system. In the case of conversion, the exchange rate of the acquiring bank or payment system is applied.

5. Exchange and return
5.1. The terms of return and exchange of goods are determined by the relevant Return Policy, which is an integral part of this Agreement.
5.2. Perfumery and cosmetic products of proper quality that have been used or have damaged packaging are not subject to return in accordance with the Resolution of the Cabinet of Ministers of Ukraine No. 172 dated March 19, 1994.
5.3. Goods of inadequate quality may be returned or exchanged in accordance with the current legislation of Ukraine or the recipient's country.
5.4. To make a return, the User must contact the Seller's support service within 14 calendar days from the date of receipt of the goods, providing supporting documents.

6. Responsibility of the parties
6.1. The Seller is not responsible for:
- User errors when entering data;
- delays in delivery due to the fault of the carrier;
- failure to fulfill obligations in the event of force majeure (war, natural disasters, blocking of logistics, etc.).
6.2. All disputes shall be resolvedare made through negotiations. In case of failure to reach an agreement - in court in accordance with the legislation of Ukraine, or the recipient's country, if applicable.
6.3. The Seller has the right to make changes to this Agreement unilaterally. The updated version is published on the Site and comes into force from the moment of publication.

7. Intellectual property
7.1. All rights to materials posted on the Site (texts, images, videos, logos, product descriptions) belong to the Seller or are used on legal grounds.
7.2. It is prohibited to copy, reproduce, distribute or use the content of the Site without the written consent of the Seller.
